Navigating the Digital Frontier: Regulatory Frameworks for Blockchain Technology and Cryptocurrencies in the United States
Abstract
The rapid proliferation of blockchain-based digital assets has outpaced the development of coherent legal frameworks in the United States, creating a fragmented, multi-agency regulatory environment that simultaneously seeks to protect investors, prevent financial crime, and preserve American competitiveness in financial innovation. This article provides a comprehensive examination of the existing regulatory architecture governing cryptocurrencies and blockchain technology in the U.S., analyzing the overlapping jurisdictions of the Securities and Exchange Commission , the Commodity Futures Trading Commission , the Financial Crimes Enforcement Network , the Internal Revenue Service , the Office of the Comptroller of the Currency , and state-level authorities. We assess the application of foundational legal tests particularly the Howey Test to digital token classification, trace the evolution of enforcement actions, evaluate the landscape of pending federal legislation, and project the trajectory of U.S. crypto regulation in a globally competitive context. The article concludes that a coherent, fit-for-purpose federal regulatory framework is both urgently needed and achievable, and outlines the contours of effective legislative design.
