Nigerian Criminal Justice System and Perennial Problems in Warri and Okaka Correctional Centers, in Delta and Bayelsa States

Abstract

This study examined the Nigerian Criminal Justice System and the Perennial Problems associated with Warri and Okaka Correctional Centres in Delta and Bayelsa States, Nigeria. This paper focused on brief history of the Nigerian Justice System; from pre-colonial, colonial, and post-colonial eras. Nigerian Criminal Justice System functions with the Judiciary, Nigeria Police Correctional Centres. The Judiciary is responsible for the interpretation of law in making sure human rights are not violated, the Police in Nigeria are responsible for fighting crime, maintenance of law and order and arrest those who violates societal laws. The correctional centres are places where inmates are kept. They keep custody, treatment, and rehabilitation of both convicted offenders and those awaiting trial. The Routine Activities Theory was adopted in this study. The findings of the study revealed that the Nigerian Criminal Justice System continues to face structural, procedural, and operational challenges that jeopardize effective justice delivery. Chronic overcrowding, protracted pre-trial imprisonment, inadequate facilities, ineffective rehabilitation programs, and instances of human rights violations are among the issues faced by Warri and Okaka Correctional Centres. It was recommended government and relevant agencies should invest appropriate resources to renovate correctional facilities, provide suitable living space, and supply vital commodities including food, clothing, and medical treatment to inmates at Warri and Okaka Correctional Centers. A fast-track trial systems should be implemented to facilitate quick adjudication of cases, especially for pre-trial detainees. This aligns with constitutional provisions of a speedy trial and protects human rights. Key Words: Nigerian Criminal Justice System, Perennial Problems, Warri and Okaka Correctional Centres.
