An Appraisal of the Legal Framework of Consular Immunity under International Law

Dr. Muhammad Ibrahim Bukar, AFHEA-UK, PhD

Abstract

The art of diplomacy, for years, has been a systematic process of communication among various interest groups or states. It is considered as one of the most valuable human engagements devoid of which human relations would have been less cohesive and conflicts would have been more prevalent. Therefore, the idea and practice of diplomatic relations represents one of the initial manifestations of customary international law. Basically, instruments and measures often designed by state actors to enable the conduct of diplomacy have some acceptable rules known as diplomatic laws. It is based on this reasoning that the international community adopted The Vienna Convention on Consular Relations of 1963 otherwise known as VCCR and the Vienna Convention on Diplomatic Relations of 1961popularly known as VCDR. However, as the topic suggests, the paper concentrated on the theme of consular immunity. It critically analyzed the underlying legal framework of consular immunity in the context of international law. To achieve this objective, the study employed the doctrinal research method, which is mainly concerned with a detailed and systematic review of statutory authorities, opinio juris, articles, international treaties and judicial precedents. The paper concluded that while there are different conditions upon which consulate staffs are licensed to enjoy immunity, at least, as enshrined in the VCCR of 1963, in most instances, their immunity is restrictive and they do not stand to benefit from the wide privileges and immunities of diplomatic staff.
