Contractual Conservation Frameworks for Advancing Nonpoint Source Pollution Reduction in Legally Contested Watersheds

Abstract

Legally contested watersheds, characterized by disputed jurisdictional authority, pending or active water rights adjudications, unresolved tribal treaty claims, interstate compact obligations, and conflicting regulatory requirements across multiple governance actors, present governance challenges that standard voluntary conservation program frameworks and regulatory nonpoint source programs are inadequate to address. Conservation easements, consent orders, adaptive management agreements, water quality trading instruments, and multi-party conservation contracts together constitute a suite of contractual conservation mechanisms with the institutional flexibility to operate across disputed jurisdictional boundaries, bridge regulatory authority gaps, and create durable water quality commitments that voluntary incentive programs and conventional regulation cannot separately achieve. This paper develops a contractual conservation framework for advancing nonpoint source pollution reduction in legally contested watersheds, synthesizing property law and transaction cost economics with watershed governance scholarship and institutional design theory. The framework analyzes conservation easements as authority-spanning legal instruments, consent order architectures as enforcement-voluntary hybrids, water quality trading markets as price-based contractual coordination mechanisms, and adaptive management agreements as governance contracts that embed iterative learning within binding institutional commitments. Illustrative framework applications drawing on governance contexts in contested western water rights watersheds, tribal treaty rights areas, interstate compact-governed river basins, and multi-TMDL impaired coastal watersheds demonstrate the framework's analytical utility and generate instrument design implications. Implications for legal instrument design, watershed governance architecture, and regulatory program innovation are developed. The framework builds on companion analyses of multi-level governance, co- management architecture, BMP adoption, and riparian restoration incentives to integrate contractual conservation within a comprehensive institutional framework for watershed governance in legally complex environments.
