Legal Research Methodology: Exploring Basic Concepts in Legal Research

Abstract

People in all works of life engage in research to find solutions to the problems facing their careers, their professions and their studies. Just as educational research focuses on solutions to educational problems, business research focuses on solutions to business problems, technical research focuses on solutions to engineering problems, medical research focuses on solutions to medical problems and social research focuses on solutions to social problems, legal research focuses on solutions to legal problems. The aim of this paper is to explore the basic concepts in legal research. It examines the nature of research generally and legal research in particular. It also examines the purpose of legal research and the characteristics that distinguish law and any research into legal principles, or writing on legal doctrines, from other disciplines. It suggests that institutions of higher learning and research funding organizations should encourage transdisciplinary research to take advantage of what other disciplines have to offer to enrich research findings and their applicability to societal needs.
